GENERAL TERMS AND CONDITIONS OF CAR RENTAL

These GENERAL TERMS AND CONDITIONS OF VEHICLE RENTAL (hereinafter, "General Terms") govern the contractual relationship between Limon Auto S.L. (hereinafter, "LimonAuto" or "Lessor") and the paying customer (hereinafter, "Lessee"), by virtue of which the former provides the latter with the use of a vehicle (hereinafter, "Vehicle") for the period, price, and other terms agreed upon in the rental contract (hereinafter, "Contract"), which will be signed at the Lessor’s premises. In case of any discrepancy between the content of the General Terms and the specific terms signed by the parties, the latter shall prevail. The Lessee is responsible for keeping a visible copy of this contract in the Vehicle at all times.

1. Subject of the Agreement:

Rental of a vehicle for private use in accordance with all General Rental Terms outlined on this website and the conditions specified in the Rental Agreement.

2. Rental Period, Delivery (Check-out), Return (Check-in) and Extension:

The minimum rental period is 2 days (48 hours), and the maximum will be specified in the Contract. Rental days are counted per 24-hour periods, with LimonAuto offering a 60-minute grace period from the Check-In time specified in the Contract. Failure to comply entitles the Lessor to charge rental fees until the Vehicle is returned, based on the Current General Rate, mileage, damages, and a penalty for economic losses — calculated daily until the Vehicle is returned or recovered and prepared. If the Vehicle is abandoned, a recovery fee plus all associated expenses will be charged. Early Check-In does not entitle the Lessee to any refund, as it is considered unilateral termination by the Lessee. If the Lessee violates any Contract clauses, the Lessor may reclaim the Vehicle and seek compensation. The Lessor may replace the Vehicle at any time due to operational reasons, after informing the Lessee. Check-Out and Check-In are to be done at the LimonAuto premises, at the time agreed in the Contract. If the Vehicle is not returned, or is abandoned, recovery costs and overdue rent apply according to the Current General Rate.

2.1. Contract Extension:

The Lessee must notify before the end of the rental period, either by phone or in person. Minimum extension is 1 day (24 hours), and subject to availability and the Contract terms. The Lessee must obtain prior approval from the Lessor and pay a deposit for the extension. The extension rate is based on the Current General Rate. The original rental rate does not apply to extensions. The Lessor may deny extensions for operational reasons. Using the Vehicle beyond the agreed period may be considered unauthorized use and reported as misappropriation. Out-of-hours returns incur a mandatory surcharge.

2.2. Check-out and Check-in Time:

Due to the checks required at both delivery and return, clients are advised to arrive early. The process can take around 30 minutes. Otherwise, the Lessee will be liable for any missing items or damages that can't be verified.

3. Driver(s):

The renter and additional drivers must be at least 25 years old and have held their driving license for 2 years. They must present a valid European ID or Passport and a driving license, both documents valid throughout the rental period, in physical form, legible, in good condition, and accepted by the country's legislation. Driving licenses in force from EU and EEA (Iceland, Liechtenstein, and Norway) citizens are accepted and valid to drive in Spain. Licenses issued in third countries will be accepted if they comply with the requirements of Article 21 of the General Drivers Regulations, provided the license is valid, the holder meets the required age in Spain to obtain an equivalent Spanish license, and no more than six months have passed since the holder acquired normal residence in Spain. In other cases, an international driving permit along with a valid driving license issued by the country of origin will be required. For additional information, we recommend checking the website of the Spanish Directorate General of Traffic (DGT): DGT – Valid permits to drive in Spain or directly contact the consulate in Spain of the issuing country. It is the client's responsibility to verify if their driving license is valid to drive in Spanish territory. Electronic or digital driving licenses from official applications will be accepted, but photographic formats or copies will not be accepted.

4. Vehicle Maintenance:

The renter receives the vehicle, equipment, and accessories in perfect condition and must keep it in good condition; no modifications, either exterior or interior, are allowed. Any modifications will result in the vehicle being restored to its original condition, and any possible damages or losses will be charged to the renter. Repairs in a workshop or replacement of parts can only be carried out with the express prior written authorization of the lessor. No repair expenses will be reimbursed unless prior consent and acceptance of the estimate and workshop performing the repair are given by the lessor. If there is no such prior written consent, the renter will be solely responsible for paying these expenses, including those for the workshop and parts.

5. Vehicle Identification:

The renter must keep the LimonAuto stickers, license plate holders, and signage on the rented vehicle for identification purposes. Removal of these elements will result in an additional charge for restoration, along with the payment of any possible administrative fine imposed for this reason. According to certain municipal ordinances, the renter must also display at all times, in a visible location, the document provided to show that the vehicle is rented. Failure to comply with this obligation will result in the renter assuming the fine and paying the management costs outlined in point 12.

6. Lost Items:

The renter must empty the vehicle of personal belongings. The lessor is not responsible for any items found in the vehicle. However, any items found in the vehicle can be returned to the renter upon an express written request to limonautorent@gmail.com. In this case, the lessor will charge a fee for the management of the return of items, as well as any costs associated with their return, which will be fully borne by the renter.

7. In Case of Breakdown or Accident Outside the Agreed Rental Period:

Once the contractual relationship between the renter and the lessor has ended (hereinafter, the Parties), the renter will be responsible for 100% of the cost of repairs and expenses incurred to the vehicle.

8. Prices and Rates:

The prices of the contract will be based on the current General Rate, which is available to the public at LimonAuto's facilities, websites, or other means the lessor deems appropriate. The renter expressly acknowledges having previously read the contents of this contract, particularly those related to the type of vehicle and the type of contract signed between the parties. All prices will be indicated and valued in euros (€). The price of fuel will be detailed at the time of the contract signing, as fuel prices fluctuate, and it is impossible to provide its value in these general terms.

9. Coverages:

The lessor provides coverages including Basic Insurance (CDW) and mandatory and voluntary civil liability (up to 50,000,000 euros), individual accidents, and legal protection. An amount of up to 600€ will be blocked on the renter's credit card as a pre-authorization to cover the excess and possible damages. If the renter returns the vehicle in the same condition it was received, the blocked amount will be refunded.

9.1. General Exclusions of Coverages and Corresponding Surcharges:

All the coverages detailed do not include the following damages to the vehicle: structural elements, undercarriage, interior or exterior equipment, as well as accessories (keys). This list is for informational purposes only. None of the coverage options will cover damages caused to the insured vehicle due to: wars, catastrophes, and natural phenomena (hailstorms, blizzards, or others), terrorism, riot, or insurrection; actions of State Security Forces, negligence by the renter, abandonment, accident, or immobilization of the vehicle due to crimes or violations committed with the vehicle and any other activities established in points 10.1 and 11. These damages and related services will be at the renter's expense. Coverage does not, under any circumstances, cover personal effects left, stored, or transported in the vehicle. DEPOSIT/SECURITY: Regardless of the coverage contracted, a deposit will be blocked on the renter's card as a guarantee for the fulfillment of obligations with the lessor, as well as a guarantee for any eventual responsibility arising during the rental period that must be assumed by the renter. This deposit will be made through a block on the card, which, if there are no incidents related to the rental and/or the vehicle used, will be released after the contract ends.

10. In the event of an accident, criminal or vandalistic act (see point 10.1) committed against the Vehicle, the Renter is obliged to:

  1. Report the incident to the police immediately.
  2. Fill out an accident report using the official form found in the Vehicle, indicating at least the license plate number, the name and address of the other party, the name of their insurer, and, if possible, the insurance policy number.
  3. Describe the accident concisely and precisely and, if applicable, note the names of any witnesses.
  4. Not make any assumptions or admit liability for the accident.
  5. Not abandon the Vehicle without taking appropriate measures to protect it from further damage, ensuring it is locked and not obstructing traffic.
  6. Immediately inform LimonAuto of the incident by calling the emergency number: +34 658834405.

The Lessor will charge a management fee for processing each accident report. In the event of an accident or criminal act, the Lessor is not obliged to provide the Renter with a replacement vehicle. In such a situation, the contract between the Lessor and the Renter will be considered terminated, and the Renter must pay all expenses derived from the Contract. The Lessor may offer a new vehicle under the current and applicable conditions at that time, to replace the one affected by the accident, criminal or vandalistic act. LimonAuto is not responsible for any damage or loss related to the goods or objects being transported. The Renter releases the Lessor from any liability for damages or defects resulting from the operation of the vehicle or in the event of an accident during the rental period.

10.1 Examples of criminal or vandalistic acts committed against the Vehicle:

Theft, burglary, or fire involving the Vehicle. Theft of interior or exterior parts of the Vehicle, such as wheels, tires, or seats. Forced entry causing damage to the windows or bodywork of the Vehicle. Acts of vandalism against the Vehicle. This list is illustrative, not exhaustive.

11. Unauthorized Use of the Vehicle:

The Renter is obligated to use the Vehicle with due diligence and care, complying with current motor vehicle traffic regulations and avoiding any situation that could cause damage to the Vehicle or third parties. Any breach of this obligation will be considered unauthorized use. The Renter must not allow anyone other than those authorized under this Contract to drive the Vehicle. In such a case, the Renter shall pay the fee for unauthorized use and will be held responsible for any damages to the Vehicle or third parties. Consequently, the Renter will be fully liable for damages caused to any part of the Vehicle resulting from unauthorized use. In the event of such use, the Renter agrees to cover all resulting expenses, which will be charged to their credit card, with full consent. The Renter’s signature on the contract shall be considered as acceptance of the General and specific Terms and Conditions.

Unauthorized use includes, but is not limited to, the following examples:

  • Participation in competitions.
  • Illegal street racing.
  • Driving without a valid license or without authorization from the Lessor.
  • Lending the vehicle to a third party.
  • Pushing or towing another vehicle.
  • Driving in areas not suitable for public transport (e.g., beaches, racing tracks).
  • Driving on roads that may cause damage to the undercarriage/oil pan.
  • Neglecting warning lights or alert signals on the dashboard that the renter acknowledges upon signing this contract.
  • Transporting furniture, except as reasonably expected in leisure rentals.
  • Transporting people or goods for direct or indirect payment (e.g., illegal taxi service).
  • Subleasing the vehicle.
  • Transporting more passengers or luggage than permitted for the vehicle.
  • Carrying luggage on the roof (roof racks are not permitted).
  • Leaving objects visible inside the vehicle.
  • Driving while fatigued, ill, or under the influence of alcohol, medication, or drugs.
  • Reckless driving.
  • Driving in violation of traffic rules.
  • Driving by a person not authorized in the contract as renter or additional driver.
  • Driving outside the permitted territory defined in point 15 of these terms.
  • Using the vehicle after the rental period has ended.
  • Not using a child or baby seat when traveling with children under 12 years old or shorter than 135 cm.
  • SMOKING INSIDE THE VEHICLE IS PROHIBITED.

12. Fines:

The Renter shall be responsible for paying any fines incurred during the rental period. The Renter must inform the Owner of any fines imposed on the Vehicle or the driver during the rental period. The Owner will always charge an administrative fee for the notification and processing of any fines imposed on the Renter. The payment of fines is not included in any of the coverages that may be contracted. If the authorities impound the Vehicle due to an act or omission by the Renter, for any reason, the Renter shall be liable and compensate the Owner for all expenses and loss of profit incurred.

13. Joint Liability:

The Renter and/or additional drivers shall be jointly and severally liable for all obligations assumed by the Renter under the Contract and all applicable laws.

14. Fuel Policy:

Full/Full: At the time of delivery, the Owner agrees to hand over the Vehicle with a full tank. Likewise, the Renter agrees to return it with a full tank. If the Owner fails to deliver the vehicle with a full tank, the Renter may demand it at the time of pickup. If not claimed at that moment, it will be understood that the Renter agrees and will not be able to make a later claim. If the Renter fails to return the vehicle with a full tank, a refueling management fee plus the cost of the missing fuel to reach 100% will be charged.

15. Permitted Territory:

The vehicle may only be driven within the national territory of Spain. Some of our vehicles are equipped with GPS trackers, and if it is detected that the permitted territory has been exceeded, it will be considered a breach of the Contract. The Owner may charge the Renter for any resulting damages and immediately terminate the Contract due to contractual breach, taking appropriate legal action. The cost of this service is detailed in the Contract.

16. Mileage:

The permitted mileage is 200 km per day during the rental period. If this is exceeded or the Vehicle is used after the Contract has ended, an excess mileage fee will be charged.

17. Vehicle Cleaning:

All vehicles are delivered clean inside and out. If the vehicle is not returned in the same condition, a cleaning fee will be charged.

18. Extras:

The Owner offers extra services/items at the cost established in the attached Annex. The Renter will be responsible for any costs in case of damage, fire, or theft of the rented extras or components not included in the car's basic equipment.

19. Gas Policy:

We do not offer cars that run on gas.

20. Payment:

All services must be paid in advance by credit card (VISA, MASTERCARD, or AMEX), debit card, or cash at our facilities. For security, a deposit must be pre-authorized in accordance with the conditions set out in sections 9 and 9.1. Online reservations can only be paid using the indicated credit or debit cards. The deposit and deductible pre-authorization can only be made using the credit card provided by the Renter or additional driver listed and signing the Contract. If no incidents occur, the deposit and deductible will be automatically released by the bank at the contract closure.

21. Taxes:

All prices detailed in the rates include Value Added Tax (VAT). The Owner is exempt from paying any other tax or fee that any state, regional, or local authority may establish during the course of this Contract.

22. Jurisdiction and Applicable Law:

This contract is governed by all applicable national legislation. The Parties expressly submit to the Transport Arbitration Boards, Courts, and Tribunals for any issues arising from this contract, except those related to consumer matters, which will be governed by the jurisdiction established in their own regulations.

22.1.

In accordance with the regulation on online consumer dispute resolution (EU Regulation No. 524/2013), reference must always be made to the EU platform for online dispute resolution. This also applies if there is no intention to participate in such a procedure.

23. Cancellation Policy:

All cancellations must be made in writing to the following email address: limonautorent@gmail.com, indicating the reservation number in the subject. For Non-Refundable Rates, no refund will be made except in cases of force majeure (natural disaster, war, terrorist attack, death or serious sudden illness of the Renter or their parents, siblings, or children) duly accredited via web, email, or postal mail.

25. Framework Agreement:

These terms and conditions serve as a framework contract and will apply to all rental agreements signed by the same Renter with LimonAuto.

26. Translation:

The Renter has the right to receive a copy of these general terms and conditions in an official language, and this will be stated in the versions written in other languages. At our offices, we will inform you which language versions are available. In case of discrepancies, the Spanish version shall prevail.

27. Privacy Policy

Processing of personal data. In accordance with GDPR 2016/679, it is hereby informed that the personal data collected here will be included in files owned by Limon Auto S.L. The collected personal data will be processed for the management of the contract and everything related to it.

Third-party data. If you provide personal data belonging to third parties, you confirm that you have obtained the consent of the affected individuals, having previously informed them of the contents of this privacy policy.

Commercial communications. I expressly agree that the data contained in the Contract may be shared in order to keep me informed, via email or any other means, of operational and commercial information as well as opinion studies related to products and services offered by Limon Auto S.L., or companies within OKGroup or partners in related sectors such as leisure, insurance, finance, and automotive. Further details can be found on our website.

Data subject rights. Individuals may exercise their rights of access, rectification, restriction, deletion, and opposition by sending a written request accompanied by a copy of their ID to the previously indicated address or via email to: limonautorent@gmail.com

Signing the Contract by the Renter will be considered as acceptance of the General and Specific Conditions stated therein.
